The tow truck was attempting to relocate a friend's van when the decedent confronted it. The defendant contended that the decedent was intoxicated with a .21 blood alcohol level. Verdict for plaintiff who was injured when the car he was driving was hit by debris discarded by a dump truck trailer which had toppled over onto its side. The defendant contended that the truck driver took evasive action in response to a phantom vehicle that cut him off. The plaintiff suffered a herniated disc at L5-S1 which required an anterior and posterior fusion. No settlement offer before trial. Verdict of $1,155,392 for the plaintiff.


Verdict for plaintiff who fell on wet wooden exterior stairs at the apartment building where she was a tenant. The plaintiff walked down the middle of the staircase despite the presence of handrails on each side. She claimed that the handrail on her right was not stable so she considered it unavailable. Landlord contended that the subject handrail was a little loose but that the other handrail was available. The plaintiff suffered a comminuted fracture of her right tibia and a spiral fracture of her right fibula. No offer by the defendant before trial. Verdict of $776,135 for the plaintiff.


Verdict for the plaintiff whose leg became entangled in the leash of the defendant's dog at a garage sale and she fell. Plaintiff suffered fractures involving her left femur. The defendant denied that the dog's leash had anything to do with the plaintiff's fall. No offer by the defendant before trial. Verdict of $278,000 for the plaintiff.


Settlement of plaintiff's product liability claim against manufacturer of wheelchair and the service company responsible for maintenance. The plaintiff fell from his wheelchair when the fasteners used to attach the arm to the wheelchair allegedly failed. The plaintiff suffered injury to his brachial plexus resulting in diminished dexterity and use of his dominant arm. Settlement of $2,950,000 for the plaintiff.

$2,000,000 settlement of medical malpractice action for 66 year old plaintiff who suffered right sided partial hemiparesis following spinal surgery.

Settlement of plaintiff's premises liability action against property owner and snow plow company that was alleged to have disrupted underground electrical line which then remained live and exposed under front entrance mat to store. Plaintiff went to move the mat and was exposed to current from electrical line. Plaintiff developed reflex sympathetic dystrophy of the exposed extremity. Settlement of $1,200,000 for the plaintiff.

Settlement of $1,200,000 paid by chemical manufacturer to man who suffered chemical burns after the manufacturer failed to warn of the need for personal protective equipment.

$1,000,000 settlement of medical malpractice action for estate of stillborn who died as a result of allegedly mismanaged shoulder dystocia at birth.

$720,000 settlement for motorcyclist who suffered facial fractures in accident with tractor trailer.
Settlement of $700,000 for woman who suffered aggravation of preexisiting complex regional pain syndrome after low speed motor vehicle accident.

Settlement of estate's claim that 67 year old unmarried father of three adult children died as a result of an undiagnosed heart attack. The decedent had been hospitalized for chest pain that resolved during a three day hospitalization. He died shortly after his discharge from the hospital. The plaintiff alleged that the attending cardiologist failed to consider lab values that suggested that the decedent had suffered a heart attack that warranted further work up. Settlement of $550,000 for the plaintiff.


$450,000 settlement for plaintiff who suffered a mild traumatic brain injury as the result of a fall at a barn.



Settlement of estate's claim that unmarried father of three adult children died as a result of negligence at the V. A. Hospital. The decedent died after falling at the V. A. while he was an inpatient receiving chemotherapy. He suffered from Stage IV multiple myeloma. It was alleged that medical staff failed to evaluate and respond to his deteriorating mental status and blood pressure. He died on the operating room table 13 hours following the fall. Settlement of $350,000 for the plaintiffs.
